Joseph Sagurs and his brother Henry asserted that Captain Daniel Philbrook and first mate Edward Kellerun of the schooner Susan did "feloniously invigle, steal, take, and carry away without the limits of the State of Georgia a negro man slave named Atticus, the property of this deponent.." on May 4, 1837.
